Application for the Variation of a Premises Licence - Dominos Pizza, 41 - 43 North Road, Durham

Consideration was given to the report of the Corporate Director, Neighbourhood Services which gave details of an application for the variation of a premises licence in respect of Dominos Pizza, 41 - 43 North Road, Durham (for copy see file of minutes).

 

A plan showing the location of the premises and a copy of the application had been circulated to Members together with copies of representations which had been received from Interested Parties.

 

The Acting Team Leader advised Members that a successful mediation meeting had taken place which had resulted in the Interested Parties withdrawn their objections to the application, subject to additional conditions being imposed, details of which had been circulated at the meeting.

 

Mr Reid the Applicant indicated that the variation was only for deliveries and advised Members of the procedures that would be put in place to comply with the additional conditions and indicated that the Interested Parties had now withdrawn their objections as they were happy following the mediation meeting.

 

Councillor Arthur sought clarification if litter bins were provided outside the premises. The Applicant responded that there were no bins but his staff cleaned up outside the premises 2/3 times per day. He advised the Sub-Committee that Dominos could provide bins if this was allowed.

 

The Acting Team Leader advised the Sub-Committee that litter was a condition of their existing Licence.

 

At 10.15 am the Sub-Committee left to deliberate the application in private. After reconvening at 10.25 am the Chair delivered the Sub-Committee’s decision.

 

In determining the application, Members had considered the report of the Licensing Officer, Section 182 Guidance and the Councils Licensing Policy, together with the verbal representations of the Applicant. They also took into account the mediation documentation which had been circulated at the meeting.

 

RESOLVED

 

That the application for a variation of the premises licence be granted as follows:-

 

Opening Hours

Monday to Sunday – 11:00 to 02:30

 

Late Night Refreshment

Monday to Sunday – 23:00 to 02:30

 

In addition the following conditions be added:-

 

i)          The front two windows and front door will be covered with blinds when the shop closes for ‘carry out’ trade.

 

ii)         Future leaflets and menus will have updated delivery terms and conditions, stating that we only deliver to addresses.

 

iii)                Continued effort to be more respectful of the local community.

 

i)                    A document will be produced that encourages a better community spirit, for example all staff will be asked to leave the shop quietly. Furthermore they will also be encouraged to clean up any boxes or rubbish that is littering the streets from our customers. This document will be a daily shift contract and failure to comply would give us grounds to discipline our staff.

 

ii)                  This will also be incorporated into our general training programme.

 

iv)        Phone numbers and contact details have been given out and are readily available to all members of the community.
