Report of the Head of Overview and Scrutiny
Purpose of Report

1. To confirm the Terms of Reference of this Committee, Membership for 2008/09, and the Dates of Meetings.

Terms of Reference

2. The Council is required under the Constitution to appoint a Overview and Scrutiny Management Committee. The formal terms of reference of the Committee are attached to this report to assist Members.

Membership of Committee 2008/09

3. The Overview and Scrutiny Management Committee will consist of 26 Members, to include the 12 Chairs and Vice Chairs of the 6 Scrutiny Committees plus co-opted members.

Dates of Meetings

4. The Committee will meet at 10 a.m. on the following days:-

21 July 2008
23 July 2008 (Special Meeting)
18 September 2008
10 November 2008
6 January 2009
9 February 2009
30 March 2009

COMMITTEE
TERMS OF REFERENCE
Overview and Scrutiny Management Committee
1. to oversee the performance of all Overview and Scrutiny functions on behalf of the Council;

2. to receive a report from the Leader after each “State of the County” debate;

3. to monitor the Overview and Scrutiny work programme, including the programme of any Committees it appoints so as to ensure that the Committee’s time is effectively and efficiently utilised;

4. where matters fall within the remit of more than one Scrutiny Committee, if necessary, to provide the final determination of which of those Committees will assume responsibility for any particular issue;

5. to put in place a system to ensure that referrals from Overview and Scrutiny to the Executive, either by way of report or for reconsideration are managed efficiently and do not exceed the limits set out in this Constitution and are, as far as possible, prioritised to achieve maximum benefit for the Council;

6. to prepare an Annual Report to the Council on the work of Overview and Scrutiny;

7. to establish appropriate liaison with the Executive;

8. to encourage appropriate community involvement in the Overview and Scrutiny role;

9. to scrutinise preparations for local government reorganisation.
