Councillor P May declared a personal interest in Item B5 as the holder of a Private Hire Driver’s Licence.

The Minutes of the meeting held on 15 December 2010 were confirmed as a correct record and signed by the Chair.

The Chair asked whether there was any other business to be considered during the public part of the meeting.  No additional items were raised.

Any resolution relating to the exclusion of the public during the discussion of items containing exempt information

That under Section 100A(4) of the Local government Act 1972, the public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraphs 1, 2, 3 and 5 of Schedule 12A to the said Act.

Application for the continuation of Hackney Carriage and Private Hire Driver's Licences

Minutes:

The Chair welcomed the Licence Holder to the meeting.  He was accompanied by his solicitor and employer.

 

Consideration was given to the report of the Corporate Director, Neighbourhood Services which requested Members to determine any action necessary in relation to the Licence Holder’s hackney carriage and private hire driver licences.

 

Representations were heard from Durham Constabulary and the Licence Holder’s solicitor responded to the issues raised.

 

The Licence Holder’s solicitor then presented his case, handing up a written reference from the Licence Holder’s employer, together with a medical report in relation to the matters the Sub-Committee was being asked to consider.   The Licence Holder and his solicitor responded to questions from the Police representative and Members of the Sub-Committee.

 

Members of the Sub-Committee retired to deliberate in private at 11.10am.

 

After reconvening at 11.25am, the Chair delivered the Sub-Committee’s decision.

 

Resolved:

 

That the suspension be lifted and the hackney carriage and private hire driver’s licences be restored.
