Consideration of the Ongoing Suitability to Continue to Hold a Personal Licence

The Committee considered a report of the Licensing Team Leader which asked Members to consider and determine the ongoing suitability of a Personal Licence Holder to continue to hold a Personal Licence (for copy see file of Minutes).

 

Members were informed that the Licence Holder was not in attendance.

 

The Licensing Team Leader advised that at a hearing on 3 October 2017 the Licence Holder had indicated that he had been unable to attend due to work commitments and had not submitted a written representation. The Sub-Committee considered that the Licence Holder should be given a further opportunity to attend in person and the hearing was adjourned.

 

The Licence Holder was advised that if he was unable to attend the re-convened hearing it would be in his best interests to provide a written representation, however he had indicated that he would be in attendance. Following a 10 minute adjournment when the Senior Licensing Officer attempted to make further contact with the Licence Holder without success, the Sub-Committee determined that the hearing should proceed in his absence.

 

In considering the ongoing suitability of the Licence Holder Members noted that he had been convicted of a relevant criminal offence.

 

At 10.25am the Sub-Committee retired to deliberate the application in private. After re-convening at 10.30am the Chairman delivered the Sub-Committee’s decision. In reaching their decision Members had taken into account the report of the Licensing Team Leader which included details of the relevant offence, and Section 4.47 of Section 182 Guidance issued by the Secretary of State.

 

Resolved:

 

That the Personal Licence be revoked.
