Application for the Ongoing Suitability of a Hackney Carriage Driver

Minutes:

Members were informed that the Licence Holder was not in attendance. The Legal Adviser advised that his representative had submitted a letter by e-mail which was received at 13.24pm immediately prior to the commencement of the Sub-Committee. The letter stated that the Licence Holder would not be attending and was seeking an adjournment.

 

The Sub-Committee adjourned at 3.15pm to allow Members to consider the request. After re-convening at 3.25pm the Chairman advised that the Sub-Committee had determined that the matter should be considered in the absence of the Licence Holder.

 

The Licensing Enforcement Team Leader presented the report on behalf of the Licensing Team and Members were given the opportunity to ask questions.

 

The Licensing Enforcement Officer presented the enforcement report and responded to questions.

 

Members were shown DVD footage of the incidents referred to in the report.

 

The representative from Durham Constabulary provided background information in relation to the convictions detailed in the report and other driving offences.

 

At 3.55pm the Sub-Committee retired to deliberate the application in private. After re-convening at 4.05pm the Chairman delivered the Sub-Committee’s decision.

 

Resolved:

 

That the Licence Holder’s Hackney Carriage Driver Licence be revoked as he was not considered to be a fit and proper person.
