Minutes:
The Chairman welcomed the Licence Holder and his representative to the meeting and introductions took place.
The Committee considered a report of the Corporate Director of Adult Services to determine the ongoing suitability of a Hackney Carriage Driver (for copy see file of minutes).
The Licence Holder’s representative requested the the Sub-Committee be adjourned as it was his opinion that some matters included in the report, prejudiced the Licence Holder. He asked for some information be redacted from the reports and a new Sub-Committee established to determine matters.
The Sub-Committee retired at 10.35 a.m. to deliberate this request and reconvened at 10.50 a.m.
The Chairman confirmed that all matters outlined in the report were relevant in determining whether the Licence Holder was a fit and proper person and therefore the application would be heard.
The Licensing Team Leader presented the report and the Licensing Enforcement Team report. Members and Officers asked questions and the Licence Holder and his representative were given the opportunity to ask questions.
Members took a few minutes to The Licensing Team Leader circulated some additional documentation on behalf of the Licence Holder.
The first witness was called by the Licensing Team Leader to present evidence respond to questions from Members, Officers and the Licence Holders representative.
A second witness was called by the Licensing Team Leader to present evidence and respond to questions from Members, Officers and the Licence Holders representative.
A third witness was called by the Licence Holder’s representative to present evidence and respond to questions from Members and Officers.
The Licence Holder’s representative was invited to address the Sub-Committee with regards to matters outlined in the report and the Licence Holder responded to questions from Members and Officers.
At the Sub-Committee retired to deliberate the application in private at 12.35 p.m. and at 13.00 p.m. the Chairman delivered the Sub-Committees decision.
Resolved:
That the Hackney Carriage Licence be subject to a final written warning.
