Minutes:
Prior to presenting the report, the Licensing Team Leader explained that the licence holder was unable to attend the hearing and she read aloud an email received from the licence holder on 17 July, which explained the circumstances which prevented the licence holder’s attendance. The Licensing Team Leader informed the Sub-Committee that she had responded to the licence holder to inform him that, if he wished to submit a written representation to the Sub-Committee in his absence, he may do so, however, no further information had been provided by the licence holder. Members discussed the matter and agreed to proceed in the licence holder’s absence.
The Sub-Committee considered the report of the Corporate Director of Neighbourhoods and Climate Change regarding ongoing suitability to hold a personal licence (for copy of report, see file of minutes). The Licensing Team Leader then responded to questions from the Sub-Committee.
The Sub-Committee retired to deliberate the matter in private at approximately 1.50 pm. After re-convening at approximately 2.00 pm, the Chair delivered the Sub-Committee’s decision. In reaching their decision the Sub-Committee considered the report of the Corporate Director of Neighbourhoods and Climate Change, the guidance issued under Section 182 of the Licensing Act 2003 and the relevant offences as defined under the Licensing Act 2003. That the licence holder’s personal licence be revoked.
