TheCommitteereceiveda reportof theCorporateDirectorof Neighbourhoodsand ClimateChangeto considerall relevantevidencegatheredin supportof an applicationto modifythe DefinitiveMap andStatementof PublicRights ofWayby upgradingpublicfootpathnumber10, Chester-le-Street(forcopysee fileof Minutes.

TheDefinitiveMap Officerprovideda detailedpresentationwhichincluded applicationevidence,site locationplans androutephotographsto supplementthe applicationandhistoricmaps ofthearea.Withinthe reportshereferred tothe evidencein supportof theRightofWaywhichwas basedonhistorical documentary evidence.Theapplicationroute,atpointA ontheroutelocationmap, connectedto apublic highway,WaldridgeLane(grid reference389554.536399)andto Public Footpath11 atpointB (currentlya publicfootpath).

TheDefinitiveMap Officerexplainedthatshould theupgradebeagreed,pointB wouldterminateon aPublic Footpath,makingit acul-de-sacpublicbridleway. However,the otherdefinitivemap modificationorderapplicationon theagenda, WaldridgeFell WaggonWayPublic Bridleway,which,if agreedwould resultina Public Bridlewaynetworkthatconnectedto publichighwaysof a higherlegalstatus.

Anamendmentwashighlightedwithin thereport thattheapplicationhadbeen receivedin March 2020,and notJuly2019.

Noobjectionswerereceivedas aresultofthe consultations.Oneletter ofsupport wassubmitted.

CouncillorKayMovedthat therecommendationbe agreed.ThiswasSecondedby CouncillorWood.

Resolved

i.     tomake aDefinitiveMap ModificationOrderto amendthe DefinitiveMap and StatementbywayofupgradingPublicRightof Way10 toa publicbridleway shownA-B onDocumentA under section53(3)(c)(ii)of the Wildlifeand CountrysideAct1981.

ii.     thatthe DefinitiveMapModificationOrder willbe referredto theSecretaryof State fordeterminationin theeventobjectionsaremadeor confirmedas an unopposedorder shouldno suchrelevantobjectionsbereceived,be noted.
