Definitive Map Modification Application to record, Waldridge Fell Waggon Way Public Bridle Road- Waldridge, Edmondsley and Chester-le-Street as a Public Bridleway

TheDefinitiveMap Officerprovideda detailedpresentationwhichincluded applicationevidence,site locationplans androutephotographsto supplementthe application,historicmaps of thearea.Withinthe reportshe referredto the evidence insupportof theRightof Waywhichwasbased onhistoricaldocumentary evidence.

 

TheDefinitiveMap Officerexplainedthatthe applicationroute,at pointA onthe route locationmap, connectedto a publichighway,BywayOpento AllTraffic11, in Chester-Le-Street(gridreference425255.551301).Therouteterminatedat point B onDocumentA whereit connectedto anotherpublichighway,WaldridgeRoad (C2) (grid reference425056.550151.Threelettersof supporthad beenreceived andtherehadbeenno objections.

 

Thelegal officerprovideda correctionto thereportthat Paragraphs4, 40 & 46of the reportreferredtothe statutorytestin Section53(3)(c)(ii)of the Wildlifeand CountrysideAct1981,howevertheyshouldhavealso referredto thetest inSection 53(3)(c)(i).Theformerrelatedto thepartsof theroute subjectof themodification applicationwhich werecurrentlyrecordedon theDefinitiveMapand Statementas footpathsandthe latterrelatedto thepart whichwas unrecorded.TheC(ii) test was thata highwayshownonthe DefinitiveMapandStatementas ahighwayof a particulardescriptionought tobe shownasa highwayofa differentdescriptionand theC(i) testwas thata Rightof WaywhichwasnotshownontheDefinitiveMap and Statementsubsistsor wasreasonablyallegedto subsist.

 

Theconclusionandrecommendationof thereport hadremainedunchangedand the applicationhadmet bothtests andthelegal officeradvisedMembersto apply thisadditionalstatutorytest.

Resolved

 

 

i.                 to make a Definitive Map Modification Order to modify the Definitive Map and Statement by way of upgrading Public Footpaths, or sections of, 11, 24 and 22 and adding a section (currently permissive footpath) of Public Bridleway between Public Footpaths 24 and 22 shown A-B on Document A under section 53(3)(c)(ii) of the Wildlife and Countryside Act 1981.

 

ii.               the Definitive Map Modification Order will be referred to the Secretary of State for determination in the event objections are made or confirmed as an unopposed order should no such relevant objections be received, be noted.
